Agreement

These Terms of Service (“Terms”) govern your access to and use of Frankenstein’s website and services at frankensteinapp.com (the “Service”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Description of the Service

Frankenstein is a creator publishing tool that helps you connect your TikTok account, prepare posts with selected videos and captions, optionally schedule posts, and review publishing status from a dashboard. Features may evolve over time. The Service is intended for human creators managing their own content choices.

Account connection

To use certain features, you may connect your TikTok account through TikTok’s authorization flow. You are responsible for maintaining the security of your credentials and for activity that occurs under your connection. You may disconnect your account using the controls we provide where available.

Acceptable use

You agree not to:

• Use the Service in violation of law or third-party rights
• Use the Service to harass, abuse, or distribute unlawful or infringing content
• Attempt to interfere with or disrupt the Service, other users, or TikTok’s platforms
• Misrepresent your identity or mislead others about the origin of content you publish
• Reverse engineer or attempt to extract source code except where permitted by law

Your content and responsibility

You retain ownership of content you upload. You are solely responsible for the videos, captions, and other materials you choose to post. You represent that you have the rights necessary to use that content. We may remove or restrict access to content or accounts where we reasonably believe these Terms or applicable policies are violated.

Third-party services

The Service integrates with TikTok and may rely on other third-party services. Your use of TikTok is also subject to TikTok’s terms and policies. We are not responsible for third-party services or changes they make.

Disclaimers and limitation of liability

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TO THE MAXIMUM EXTENT PERMITTED BY LAW, FRANKENSTEIN AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS OR THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM (IF ANY).

Indemnity

You will defend and indemnify Frankenstein and its affiliates against any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your content, your use of the Service, or your violation of these Terms.

Changes to the Terms

We may modify these Terms from time to time. We will post the updated Terms on this page and update the “Last updated” date. Continued use of the Service after changes constitutes acceptance of the revised Terms.
